My situation:
1. EAD (OPT) valid until 6/29/07
2. H-1B approved with premium processing.

Attorneys Comment:
1. Is it true that my status expires when my EAD expires?
2. Is it true that I will not get 60 days grace period (after my EAD expires) automatically and it is up to USCIS whether they want to grant it or not (if granted they will mention about grace period in memo)?
3. Is it true that I need to leave and re-enter US in order to obtain H-1B (as I don’t have new I-94 at the bottom of my approval)?

oh my god, thats scary, may be u will have to go out of us and re enter with the h1b visa. i also heard h1b is usually not rejected. so if ur h1 is approved why dont u go home take a break and come back. good luck.

If you don't have new I-94 with your approval notice than you have to reenter to US. to re-enter US you need H1 B stamp on your passport. You have to go to either Canada, Mexico or, NEPAL to get visa. I am not sure about 60 days grace period. Did you use your 60 days period already? What is your EAD start days ? if is is very next day of the end date of your school than you have 60 days left but you can't work on that period.

what does these means, this is a law:

Grace Periods - 214.2(f)(5)(iv)

"Students who have completed their course of study and any authorized practical training have a 60-day grace period after expiration of F-1 status. The 60 days run from the end date of the completion of the course of study or the end date of any authorized practical training, whichever is later."
